The Supreme Court ruled 6-3 that IEEPA does not authorize tariffs. Importers who paid IEEPA duties may be eligible for refunds.

Who's Eligible?

Importers of record who paid IEEPA tariffs (reciprocal tariffs, fentanyl tariffs on China/Mexico/Canada, Russian oil surcharges, or Brazil tariffs) between April 2025 and February 24, 2026. This includes the "Liberation Day" reciprocal tariffs at rates ranging from 10% to 145%.
